This Privacy Policy applies to those who visit www.joinballoon.com and subdomains of this domain (“Site” or “Sites”), as well as users of Balloon services and products (collectively, with the Site, the “Service” or “Services”) which is owned and operated by Balloon Technologies Inc. (“BALLOON”, “We”, “Us” or “Our”). This Privacy Policy describes how BALLOON collects, uses and shares the Personal Data (defined below) you provide to us. It also describes the choices available to you regarding the use of, your access to, and how to update and correct your Personal Data.

By accessing or using the Service, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, you may not access or use the Service.

What Personal Data do we collect?

Personal Data

While accessing or using our Service, you may provide us with certain information that, alone or in combination with other information, can be used to contact or identify you (“Personal Data”). The Personal Data collected during these interactions may vary based on what you choose to share with us, but it will generally include:

  • Email address
  • First name and last name
  • Phone number
  • Address, City, State, Province, ZIP/Postal code

Usage Data

When you visit, use and interact with the Service, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit our Service, peak hours of visits, which page(s) are visited on our Service, the domains our visitors come from (e.g., google.com, bing.com, etc.), and which browsers people use to access and visit our Service (e.g., Google Chrome, Microsoft Edge, etc.), broad geographical information, and Service-navigation pattern.  In particular, the following information is created and automatically logged in our systems:

  • Log data: Information (“log data”) that your browser automatically sends whenever you visit the Service. Log data includes your Internet Protocol (“IP”) address (so we understand which country you are connecting from when you visit the Service), browser type and settings, the date and time of your request, and how you interacted with the Service.

  • Device information: Includes name of the device, unique device ID and other device identifiers, operating system, browser you are using, and other diagnostic data. Information collected may depend on the type of device you use and its settings.

Tracking & Cookies Data

Cookies

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

Analytics

We may use third-party service providers to monitor and analyze the use of our Service.

  • Mixpanel: Mixpanel is a business analytics service company. It tracks user interactions with web and mobile applications and provides tools for targeted communication with them. Its toolset contains in-app A/B tests and user survey forms. Data collected is used to build custom reports and measure user engagement and retention. Mixpanel may use the collected data.   • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Third-Party Widgets

Our blogs and forums might contain widgets and social media features, such as the Twitter “tweet” or Facebook “like” buttons. These widgets and features may collect your IP address, which page you are visiting on the Services, and may set a cookie to enable the feature to function properly. Widgets and social media features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing it.

What do we use your Personal Data for?

We use Personal Data to provide and facilitate your engagement with the Service, including your organization of, registration for and attendance at the virtual events we make available.  This processing is necessary to perform our contract with you.

We also use Personal Data as necessary for the following legitimate business interests:

  • To respond to your inquiries, comments, feedback or questions;
  • To manage our relationship with you, which includes sending administrative information to you relating to our Service and changes to our terms, conditions, and policies, providing support, and asking you to leave a review or take a survey;
  • To analyze how you interact with our Service and provide, maintain and improve the content and functionality of the Service and our customer relationships and experiences, develop our business and inform our marketing strategy (please see the “Cookies” section below to learn how we use cookies);
  • To administer and protect our business and the Service, prevent fraud, criminal activity, or misuses of our Site, and to ensure the security of our IT systems, architecture and networks (including troubleshooting, testing, system maintenance, support and hosting of data); and
  • To comply with legal obligations and legal process and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or other third parties, and enforce our terms and policies.

Marketing

We may contact you to provide information we believe will be of interest to you. For instance, if you elect to provide your email address, we may use that information to send you promotional information about our products and services. If we do, where required by law, for example if you are in the EU, we will only send you such emails if you consent to us doing so at the time you provide us with your Personal Data. You may opt out of receiving emails by following the instructions contained in each promotional email we send you or by contacting us. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding our Services and to respond to your requests.

How do we protect your Personal Data?

You use the Service at your own risk. We implement a variety of security measures designed to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to us via the Internet. Do we share any Personal Data with outside parties?

We will share your Personal Data with third parties as described in this Privacy Policy.  When you register for or attend an event, we will share your Personal Data with the organizer of such event.

We may also share your Personal Data pursuant to your instructions, which may be issued in connection with your use of the Service.  For example:

  • Other users (where you post information publicly or as otherwise necessary to effect a transaction initiated or authorized by you through the Services).
  • Social media services (if you intentionally interact with them through your use of the Services).
  • Third-party business partners who you access through the Services.
  • Any other third party with your prior consent.

In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth below:

  • Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with service providers, including hosting, cloud services and other information technology services providers; event management, email communication software providers and email newsletter providers; database and sales/customer relationship management services; payment processors; web analytics services (for more details on the third parties that place cookies through the Service, please see the “Cookies” section); staff augmentation and contract personnel; and security and fraud prevention consultants.  Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us.
  • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.
  • Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with legal or regulatory obligations, including to respond to lawful requests from public authorities and to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Site, or the public, or (v) protect against legal liability.

EU Users

This section applies to individuals in the EU (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway, the United Kingdom, and, to the extent applicable, Switzerland).  

Legal Basis for Processing. This Privacy Policy (the paragraph “What Do We Use Your Personal Data For”) describes the legal basis we rely on for the processing of your Personal Data. Please contact us if you have any questions about the specific legal basis we are relying on to process your Personal Data.

As used in this Privacy Policy, “legitimate interests” means our interests in conducting our business and developing a business relationship with you. This Privacy Policy describes when we process your Personal Data for our legitimate interests, what these interests are and your rights. We will not use your Personal Data for activities where the impact on you overrides our interests, unless we have your consent or those activities are otherwise required or permitted by law.

User Rights. Just as we have our rights and obligations to process your personal information, you also have certain rights to process your Personal Data. These rights include, under certain circumstances:

  • Right of access: In accordance with Art. 15 GDPR, you may have the right to obtain confirmation from us as to whether or not your personal data is processed by us, and, where that is the case, to request access to your personal data. The information about personal data processing includes the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipients to whom your personal data have been or may be disclosed. However, this is not an absolute right and the interests of other individuals may restrict your right of access. Also, you may have the right to obtain a copy of your personal data undergoing processing. For additional copies requested, we may charge a reasonable fee based on administrative costs.
  • Right to rectification: In accordance with Art. 16 GDPR, you may have the right to obtain from us the rectification of inaccurate personal data. Depending on the purposes of the processing, you may have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
  • Right to erasure (right to be forgotten): In accordance with Art. 17 GDPR, you have the right to request that we delete your personal data. Please keep in mind that we may keep your personal data if it is still necessary for:
  • fulfilling our legal obligation;
  • archival, historical, or scientific research or statistical purposes; or
  • determination, exercise, or defense of our legal claims.
  • Right to restriction of processing: In accordance with Art. 18 GDPR, you have the right to request that we restrict the processing of your personal data. In this case, the respective personal data will be marked accordingly and may only be processed by us for certain purposes.
  • Right to personal data portability: In accordance with Art. 20 GDPR, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format and/or to request the transfer of this personal data to another entity.
  • Right to object: You may ask us at any time to stop processing your Personal Data, and we will do so:
  • If we are relying on a legitimate interest to process your Personal Data -- unless we demonstrate compelling legitimate grounds for the processing or we need to process your data in order to establish, exercise, or defend legal claims;
  • If we are processing your Personal Data for direct marketing. We may keep minimum information about you in a suppression list in order to ensure your choices are respected in the future and to comply with data protection laws (such processing is necessary for our and your legitimate interest in pursuing the purposes described above);
  • Right to revoke consent: If you have given your consent to the processing of your data in accordance with Art. 7 III GDPR, you may revoke your consent at any time in the future. The declaration of revocation must be addressed to us and must be presented in writing or delivered by email or fax.  Withdrawal of consent will not affect any processing of your data before we received notice that you wished to withdraw consent.
  • Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices, including the way we handled your Personal Data, you can report it to the data protection authority that is authorized to hear those concerns (in the UK, the Information Commissioner’s Office (ICO), who can be contacted at https://ico.org.uk/concerns, and in other EU countries the data protection authority of the country in which you are located).

Information Related to Personal Data Collected through our Services on Behalf of our Customers. For certain Personal Data collected and processed on behalf of our event organizer customers, Balloon is considered a processor or sub-processor under the direction of our customers who are considered controllers or processors. For such Personal Data, we may direct you to submit any inquiries or data subject requests we receive to such customer.  If requested to remove Personal Data by our customer, we will respond within a reasonable timeframe.

International Transfers

Company is based in the United States. While the Company maintains servers in the EU, if you are accessing our Service from the EU or other regions with laws governing data collection and use, please note that your Personal Data may be transferred to and stored in the United States as necessary for the purposes described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above). The United States may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located.

User Choices and Do Not Track

  • Choices

You have the ability to determine what Personal Data you make available to us, but if you choose not to provide information that is needed to use some features of our Service, you may be unable to use those features. You can also contact us to request access to your data or to ask us to update, correct, or delete your Personal Data.

  • Online Tracking and Do Not Track Signals

We may, and we may allow third party service providers to, use cookies or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Service. Our Service currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will describe how we do so in this Privacy Policy.

Data Retention

We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (e.g. for tax, legal, accounting or other purposes), whichever is longer.  Even if you close your account with BALLOON, we will still retain and use your Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. However, we will identify your account in our database as “deleted” or “closed”.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt out of receiving these communications and in accordance with our policies.

To determine the appropriate retention period for your Personal Data, we will consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we use your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Our Policy towards Children

The BALLOON products and/or services are not directed at persons under 16 and we do not knowingly collect Personal Information from children under 16. If you become aware that your child has provided us with Personal Information, without your consent, then please contact us using the details below so that we can endeavor to remove such information and terminate any account your child has created with us.

Occasionally, at our discretion, we may include links to our merchant partners (third party products or services) on our Service. These third party’s websites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked websites. Nonetheless, we seek to protect the integrity of our Service and welcome any feedback about these third party websites.

The Services may include links that direct you to other websites or services whose privacy practices may differ from ours. Your use of and any information you submit to any of those third-party sites is governed by their privacy policies, not this one.

Changes to our Privacy Policy

The Service, and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Service or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you if applicable, you consent to the revised Privacy Policy and practices described in it.
